These Terms govern your use of BoostMyEats.com and all services provided by BoostMyEats LLC, located at Coffeen Avenue STE 1200, Sheridan, Wyoming 82801.
By using our website or purchasing any service, you agree to these Terms.
BoostMyEats LLC provides AI-generated and True-Dish™ Technology food photography services based on images supplied by the customer or publicly available restaurant listings (Uber Eats, DoorDash, Grubhub, etc. when authorized).
You acknowledge the following:
To ensure the highest quality optimization and rapid turnaround times, the standard Menu Makeover package covers the full optimization (Photos, Descriptions, Titles) of up to 40 individual menu items (your "Core Menu").
Prioritization: For menus exceeding 40 items, BoostMyEats LLC reserves the right to prioritize high-impact revenue drivers (e.g., Mains, Chef's Specials, Family Bundles) and exclude low-impact auxiliary items (e.g., Beverages, Sauces, Extra Toppings, Side Dishes) from the optimization process.
Mega-Menus: If you require optimization for a menu significantly larger than 40 items, a custom quote or "Catalog Extension" add-on may be required.
Revision Policy:
To maintain our 48-hour delivery timeline, this Service includes one (1) round of consolidated revisions.
You represent and warrant that:
You grant BoostMyEats LLC a non-exclusive license to process, enhance, modify, and deliver the final product to you.
All payments are due upfront unless otherwise stated.
Subscriptions: If you opt into the "Growth Subscription," it renews automatically every 30 days until canceled.
Cancellation: Cancellation stops future billing but does not retroactively refund past payments unless covered by the 30-day Money-Back Guarantee.
The Trial: By accepting the "1 Month Free" offer, you authorize BoostMyEats LLC to store your payment method on file. You will not be charged the monthly subscription fee ($149) for the first 30 days.
The Charge: Upon the expiration of the 30-day trial period, your payment method will automatically be charged $149.00 (plus applicable taxes) for the upcoming month. This charge will recur every 30 days thereafter.
Cancellation: To avoid being charged, you must cancel your subscription before the renewal date. You may cancel at any time by emailing support@boostmyeats.com.
Refunds: We do not offer refunds for recurring subscription charges once they have processed. It is your responsibility to cancel before the billing cycle hits.
IMPORTANT: All statistics, performance claims, revenue projections, and success metrics displayed on our website, marketing materials, payment pages, and promotional content are provided for illustrative purposes only and do not constitute a guarantee of results.

Your actual results will vary significantly based on numerous factors outside of our control, including but not limited to: your local market competition, food quality, pricing strategy, delivery times, customer ratings, platform algorithm updates, and general economic conditions.
By using our services, you acknowledge that we provide optimization assets (photos, copy, settings). We do not control the delivery platform's algorithm or consumer behavior. You are solely responsible for your business outcomes.
All True-Dish™ Technology photos delivered to you become your property upon successful payment.
BoostMyEats LLC retains the right to use anonymized, non-identifying before/after images for marketing purposes unless removal is requested via email.
BoostMyEats LLC is not liable for:

These Terms are governed by the laws of the State of Wyoming.
If you opt into the "Reputation Shield" add-on ($49/mo), the following terms apply:
Best Efforts Basis: We will use professional best practices to dispute unfair or fraudulent 1-star reviews with delivery platforms (Uber Eats, DoorDash, etc.). However, we cannot guarantee the removal of any review. The final decision lies solely with the platform's internal moderation team.
Platform Compliance: We will strictly adhere to the Terms of Service of the delivery platforms. We will not use bots, fake reviews, or incentivized ratings to artificially boost your score, as this can lead to your store being banned.
Response Authority: You grant BoostMyEats LLC the authority to reply to public customer reviews on your behalf using our professional judgment.
The "Growth Partner Plan" ($149/mo) includes the following monthly allowances:
Menu Updates: Includes up to four (4) "Update Tickets" per month. A single ticket constitutes a consolidated batch of changes (e.g., changing prices on 10 items, or marking 3 items out of stock). Requests exceeding this limit may be subject to a la carte fees or pushed to the next billing cycle.
Support Turnaround: "Priority Support" is defined as a guaranteed response within 24 business hours. This service does not include immediate/live chat support or emergency technical troubleshooting (e.g., tablet hardware failure).
Access & Connectivity: It is the Client's responsibility to ensure BoostMyEats has active, working login credentials. If we cannot access your account due to a password change or 2FA lockout caused by the Client, the monthly subscription fee is still due and non-refundable.
The following terms apply specifically to individual photo purchases or "Stock Match" services:
You acknowledge that "True-Dish™" images for A La Carte purchases are artistic representations/stock matches and may not depict the exact plating of your kitchen.
We will provide generic visual equivalents for trademarked items (e.g., Oreos, Coke) to avoid infringement.
You acknowledge that "Stock Match" and "True-Dish™" images are artistic representations of the menu item described.
Likeness: While we aim for high accuracy, the final image is a "Best-in-Class" representation. It may not reflect the exact plating style, portion size, or specific ingredients used in your kitchen. (e.g., A "Pepperoni Pizza" image will show a high-quality pepperoni pizza, but may not match your specific crust thickness or pepperoni count).
Liability: BoostMyEats LLC is not liable for customer complaints regarding visual discrepancies between the digital image and the delivered food. It is the Client's responsibility to ensure the image is a reasonable representation of their product.
Your menu selection includes trademarked brand names (e.g., "Oreo® Cheesecake," "Gatorade®," "Coke®").
Generic Usage: Unless you provide a photo of the actual branded product to be enhanced, our "Stock Match" service will provide a generic equivalent or a stylistically similar representation that avoids trademark infringement (e.g., a chocolate sandwich cookie cheesecake rather than one displaying the official Oreo logo).
Indemnification: You agree to indemnify BoostMyEats LLC against any trademark claims resulting from the use of brand names in your menu descriptions or imagery.
Our "100% Satisfaction or Money Back" guarantee allows you to request a full refund for any specific image you are not happy with.
Revocation: Upon issuance of a refund for a specific image, the usage license for that image is immediately revoked. You must delete the file and remove it from all platforms (Uber Eats, DoorDash, Website). Continued use of a refunded image constitutes copyright infringement.
Content calendars are sent 5 days in advance. If no feedback is received within 48 hours, content is deemed Approved and auto-published.
"Reels" are defined as AI-Motion/Remixed videos using static assets. This service does not include on-site videography.
Source Material: You authorize us to use images and videos from your public profiles (Instagram, Facebook, Google Maps, Yelp, Website) and user-generated content (tagged photos) to create your posts.
Stock & AI: We may supplement your specific food photos with high-quality, non-branded lifestyle imagery or AI-enhanced backgrounds to maintain aesthetic quality.
Disconnects: It is the Client's responsibility to ensure our posting tool remains connected (e.g., re-authenticating Facebook/Instagram tokens when passwords change). We are not responsible for missed posts during periods where our access tokens are revoked or expired.
This service utilizes Generative AI technology. While highly accurate, occasional hallucinations (errors) may occur. BoostMyEats LLC is not liable for revenue loss due to AI misinterpretation of orders.
By using this service, the Client agrees to comply with all local "Two-Party Consent" laws regarding call recording and must enable the "Call Recorded" disclosure if required by law.
Call Volume: "Unlimited" AI minutes are subject to a fair use policy (1,500 minutes/month for Order Taker plan). Excessive usage may result in overage charges or plan review.
Order Accuracy: While our AI is trained on your menu, complex modifications or unclear speech may result in order errors. The Client is responsible for verifying orders before preparation.
Integration: POS integration is provided on a "best efforts" basis and depends on your specific system's compatibility.
If you opt into the "Missed Call Back" add-on, you authorize BoostMyEats to send automated SMS messages on your behalf to callers who disconnect before speaking with the AI. Standard messaging rates may apply to recipients.
The following terms apply specifically to the "Front-of-House" AI Voice service:
The Law: Many jurisdictions (including California, Florida, Pennsylvania, etc.) require all parties on a phone call to consent to being recorded.
Your Responsibility: By using this Service, you acknowledge that BoostMyEats LLC records all incoming audio for processing and quality assurance. You agree to ensure your use of the Service complies with local laws, which may require you to enable a pre-recorded announcement stating: "This call may be recorded for quality assurance."
Indemnification: You agree to indemnify and hold harmless BoostMyEats LLC against any legal claims, fines, or damages arising from your failure to provide adequate notice of call recording to your callers.
Nature of Technology: You acknowledge that the Service uses Generative AI (Large Language Models), which may occasionally generate incorrect, factually inaccurate, or "hallucinated" responses (e.g., quoting a wrong price, promising a menu item that is out of stock, or misinterpreting an allergy request).
Limitation of Liability: BoostMyEats LLC is not liable for any revenue loss, cost of free food, or customer dissatisfaction resulting from AI errors. It is the Client's responsibility to review call transcripts and adjust the System Prompt/Knowledge Base if errors occur.
No Emergency Access: The AI Receptionist is not a replacement for a landline or phone carrier. It cannot dial 911 or connect callers to emergency services. You must maintain a separate phone line for safety-critical communications.
Billing Triggers: Calls exceeding the monthly included minute allowance will be billed automatically at the flat rate specified in your plan ($0.40/min for Hostess, $0.25/min for Order Taker).
Calculation: Duration is calculated in 60-second increments, rounded up to the nearest minute.
Payment: Overage fees are calculated at the end of the billing cycle and charged to the payment method on file. Failure to pay overage fees will result in immediate suspension of the AI service.
Consent: If you enable the "Missed Call Text Back" or "SMS Order Link" features, you represent that you have obtained the necessary consent to send automated text messages to your customers under the Telephone Consumer Protection Act (TCPA).
Opt-Out: The System automatically handles "STOP" keywords, but you are responsible for ensuring you do not manually spam customers who have opted out.
From time to time, BoostMyEats LLC may offer special promotions, holiday sales, or discounted rates (e.g., "Christmas Special," "Black Friday Deal").
Eligibility: Unless explicitly stated otherwise, all advertised price reductions, "strike-through" pricing, and coupon codes are valid for New Clients only.
Definition: A "New Client" is defined as a business entity or individual who has not held an active, paid subscription with BoostMyEats LLC within the past ninety (90) days.
Existing Clients: Current subscribers cannot cancel their existing plan and immediately re-subscribe to claim a lower promotional rate.
Enforcement: If we detect that a current or recent client has created a new account to bypass standard pricing, BoostMyEats LLC reserves the right to:
No Refunds: Promotional pricing cannot be applied retroactively to past payments. You cannot request a refund or credit for the difference between your current rate and a newly advertised promotional rate.
